Terms of Use for Maison Mo

Important Notice

These Terms contain a binding arbitration agreement, a class action waiver, and a waiver of the right to a jury trial. Please review Section 21 carefully.

1. About These Terms

These Terms and Conditions govern your access to and use of the MAISON MO website, online store, customer accounts, communications, products, content, and services, including maisonmo-mmo.com and any related pages, features, or services that link to these Terms.

Throughout these Terms, “MAISON MO,” “we,” “us,” and “our” refer to MAISON MO and the person or legal entity that owns and operates the MAISON MO business. “You” and “your” refer to the person accessing the Services or purchasing a product.

By visiting the website, creating an account, submitting information, or placing an order, you agree to these Terms and our Privacy Policy. Do not access the Services or place an order if you do not agree.

2. Eligibility

You must be at least 18 years old, or the legal age of majority where you live, to place an order.

By using the Services, you represent that:

  1. You have the legal capacity to enter into a binding agreement.
  2. The information you provide is accurate and complete.
  3. You will use the Services only for lawful purposes.
  4. You are authorized to use any payment method submitted with an order.

The Services are not directed to children under 13.

3. Changes to These Terms

We may revise these Terms periodically to reflect changes to our business, Services, practices, or legal obligations.

Updated Terms will be posted with a revised “Last Updated” date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Services after the revised Terms become effective constitutes acceptance of the updated Terms.

A change to the arbitration provisions will not apply to a dispute of which MAISON MO had actual written notice before the change became effective.

4. Accounts and Account Security

Certain features may require an account. You agree to provide accurate, current, and complete information and to update it when necessary.

You are responsible for:

  1. Protecting your password and login credentials.
  2. Restricting access to your account and devices.
  3. Activities performed through your account, except to the extent caused by our failure to use reasonable security measures.
  4. Notifying us promptly of suspected unauthorized use.

We may refuse, suspend, restrict, or terminate an account when we reasonably believe it is associated with fraud, unlawful activity, abusive conduct, unauthorized resale, security threats, chargeback abuse, or a violation of these Terms.

5. Product Character and Handmade Variations

MAISON MO creates limited, small batch, handmade, hand-finished, and artistically considered pieces.

Variations may naturally occur in:

  1. Fabric texture, weave, grain, or color.
  2. Dye tone or placement.
  3. Stitching and hand finishing.
  4. Print, embellishment, or pattern placement.
  5. Dimensions and measurements.
  6. Hardware and natural materials.
  7. Surface texture or finishing.
  8. Construction details between individual pieces.

Natural and minor variations resulting from materials, handwork, photography, production methods, or the individual nature of a piece are not defects unless they materially impair the product’s intended function or materially contradict its description.

We make reasonable efforts to display colors, materials, proportions, measurements, and product details accurately. However:

  1. Screen and device settings may display colors differently.
  2. Measurements are approximate unless expressly stated otherwise.
  3. Product images may contain styling pieces, accessories, props, or garments that are not included.
  4. Image cropping and lighting may affect perceived dimensions or color.
  5. A product may differ slightly from an editorial or campaign image.

You are responsible for reviewing the product description, measurements, sizing information, disclosed characteristics, and care instructions before ordering.

6. Availability and Order Acceptance

Products may be produced in very limited quantities and may sell out without notice. Placing an item in your cart does not reserve it.

Submitting an order constitutes an offer to purchase. An automated confirmation only acknowledges that we received the order. It does not mean that MAISON MO has accepted it.

An order is accepted when we:

  1. Send an express acceptance or shipment confirmation.
  2. Capture payment after completing our review.
  3. Dispatch the product.

We may refuse, limit, or cancel an order before acceptance for reasons including:

  1. Product unavailability.
  2. Incorrect product, inventory, pricing, or promotional information.
  3. Suspected fraud or unauthorized payment.
  4. Purchase quantity or resale concerns.
  5. Shipping restrictions.
  6. An incorrect or unverifiable address.
  7. A request from a payment provider, carrier, government agency, or law enforcement authority.
  8. A technical or inventory error.
  9. A violation of these Terms.

If we cancel an order after collecting payment, we will refund the collected amount associated with the canceled item and any related unused shipping charge. Except where applicable law requires another remedy, that refund will be your remedy for an order canceled before shipment.

7. Prices, Taxes, and Errors

Prices are displayed in the currency shown at checkout and may change before an order is accepted.

Unless expressly stated, prices do not include:

  1. Sales or use taxes.
  2. Shipping charges.
  3. Customs duties.
  4. Import taxes.
  5. Brokerage fees.
  6. International handling charges.

You are responsible for taxes and government charges associated with your purchase, except taxes imposed directly on MAISON MO’s net income.

We may correct pricing, inventory, typographical, promotional, or product information errors before accepting an order.

If an accepted order contains a material pricing error, we may contact you to obtain approval of the corrected price or cancel and refund the affected order, subject to applicable law.

Applicable sales and use taxes are calculated at checkout based on the delivery address, order contents, applicable tax rates, exemptions, and other information available to MAISON MO. MAISON MO will collect taxes where it determines collection is required or authorized by applicable law. Tax estimates and final amounts may change if the shipping address, order details, tax rates, exemptions, or governing law changes. Customers remain responsible for taxes, duties, customs charges, and other government assessments that MAISON MO is not legally required or authorized to collect.

8. Payment and Fraud Prevention

You authorize MAISON MO and its payment service providers to charge your selected payment method for the total displayed at checkout.

You represent that:

  1. You are authorized to use the payment method.
  2. The billing information is accurate.
  3. The transaction is not fraudulent or unlawful.

We may use lawful fraud prevention measures, including identity verification, address verification, transaction screening, purchase limits, and manual order review.

Payment card information may be collected and processed directly by third-party payment providers. MAISON MO may not receive or store the complete payment card number.

Contact us promptly if you believe a charge is incorrect. Nothing in these Terms limits any nonwaivable right concerning an unauthorized transaction.

We reserve the right to dispute fraudulent, abusive, or bad-faith chargebacks and may provide relevant transaction, delivery, account, acceptance, and communication records to payment processors, banks, insurers, and other involved parties.

9. Shipping and Delivery

Available shipping methods, charges, destinations, and estimated delivery periods are shown at checkout or in our Delivery and Returns Policy.

Shipping and delivery dates are estimates unless we expressly provide a written guarantee. We will comply with applicable requirements relating to shipment timing, delay notices, consent to delay, cancellation, and refunds.

You are responsible for providing a complete, accurate, and accessible delivery address.

MAISON MO is not responsible for delays, losses, or costs caused by:

  1. An incorrect, incomplete, or outdated address supplied by you.
  2. An inaccessible location.
  3. A recipient’s refusal or failure to accept delivery.
  4. Unpaid customs duties or import charges.
  5. Carrier delays.
  6. Customs processing.
  7. Weather or transportation disruption.
  8. Government action.
  9. Events outside our reasonable control.

A shipment may require a signature.

To the fullest extent permitted by law, carrier tracking, a signature record, delivery photograph, concierge record, mailroom confirmation, authorized recipient record, or access-point delivery record may be treated as evidence of delivery.

Report an order marked as delivered but not received within seven calendar days after the carrier’s delivery confirmation. We may require reasonable cooperation with a carrier investigation, insurer, identity verification process, sworn statement, or police report.

10. International Orders

International orders may be subject to customs inspections, duties, taxes, brokerage charges, and local fees.

Unless checkout expressly states that duties and taxes are included, the recipient is responsible for those charges.

You are responsible for confirming that the products may lawfully be imported into the destination country. MAISON MO may refuse or cancel an order to a restricted destination.

When an international shipment is refused, abandoned, unclaimed, rejected by customs, or returned because duties were unpaid or delivery details were incorrect, we may deduct the following from any refund, to the extent permitted by law:

  1. Original shipping charges.
  2. Return shipping charges.
  3. Customs duties and taxes.
  4. Brokerage fees.
  5. Storage charges.
  6. Other nonrecoverable costs.

11. Returns, Exchanges, and Refunds

The Delivery and Returns Policy displayed on our website and at the time of purchase is incorporated into these Terms.

Eligible products may be returned only when all applicable conditions are satisfied, including:

  1. A return request is submitted within the stated return period.
  2. MAISON MO issues a return authorization.
  3. The product is shipped within the authorized period.
  4. The product is unworn, unused, unwashed, unaltered, and undamaged.
  5. The product is free from odor, cosmetics, pet hair, lint, stains, and signs of use.
  6. Original tags, protective materials, accessories, packaging, certificates, and documentation are included.
  7. The return uses a trackable and adequately insured method.

MAISON MO may reject a return that does not meet the published return conditions, subject to rights that cannot legally be waived.

Except where defective, incorrectly shipped, materially misdescribed, or otherwise required by law, the following may be final sale:

  1. Made-to-order items.
  2. Custom or personalized items.
  3. Monogrammed or signed items.
  4. Altered garments.
  5. Specially sourced pieces.
  6. Items marked “Final Sale.”
  7. Gift cards.
  8. Hygiene-sensitive products after a protective seal has been removed.
  9. Products damaged through wear, misuse, accident, improper storage, alteration, cleaning, or failure to follow care instructions.
  10. Shipping charges, customs duties, import taxes, brokerage fees, and return shipping costs.

Approved refunds will normally be returned to the original payment method. We may withhold a refund until we receive and inspect the returned item or receive acceptable proof of return, as permitted by law.

Bank and payment provider processing times are outside MAISON MO’s control.

Nothing in this section limits nonwaivable rights concerning defective, misdescribed, or nonconforming products.

12. Preorders, Made-to-Order Items, and Custom Work

A product identified as a preorder, made-to-order item, custom item, personalized item, or commissioned piece may require an extended production period.

Any completion or shipment date is an estimate unless MAISON MO expressly guarantees it in writing.

Production delays may result from:

  1. Material availability.
  2. Artisan production.
  3. Hand finishing.
  4. Quality review.
  5. Customs or transportation.
  6. Supplier delay.
  7. Events outside our reasonable control.

When legally required, we will provide an opportunity to consent to a revised shipment date or cancel the unshipped order.

Unless otherwise stated in writing, a custom or made-to-order purchase may only be canceled before material cutting, personalization, alteration, special sourcing, or production begins.

Once such work begins, the order is final sale except where the product is defective, materially misdescribed, or a remedy is required by law.

Design fees, sourcing charges, and deposits may be nonrefundable once the applicable work has begun, to the extent permitted by law.

13. Promotions and Gift Cards

Promotions may be subject to separate terms, eligibility requirements, exclusions, geographic restrictions, product limits, and expiration dates.

Promotions:

  1. Have no cash value.
  2. Cannot be combined unless expressly stated.
  3. May be restricted to one use per person, household, address, account, or payment method.
  4. May be modified or canceled before an order is accepted.
  5. May be invalidated when obtained or used fraudulently.

Gift cards are governed by applicable law and any separate gift card terms. We are not responsible for unauthorized use of a gift card after valid delivery, except where required by law.

14. Care, Use, and Alterations

You are responsible for following the care instructions provided with a product or displayed on the product page.

Natural wear, improper cleaning, misuse, accidents, poor storage, unauthorized repair, and third-party alteration may affect eligibility for a return, refund, replacement, or other remedy.

Alterations performed by a third-party tailor, cleaner, repair provider, or other service are undertaken at your risk. MAISON MO is not responsible for damage, fit issues, discoloration, shrinkage, or construction changes caused by third-party services.

15. Intellectual Property

The Services and all associated materials are owned by MAISON MO or its licensors and are protected by applicable intellectual property and unfair competition laws.

Protected materials include:

  1. The MAISON MO name and logos.
  2. Trademarks and brand identifiers.
  3. Garment and accessory designs.
  4. Patterns and original artwork.
  5. Photographs and videos.
  6. Website copy and editorial content.
  7. Graphics, layouts, and visual presentation.
  8. Software and website features.
  9. Campaign concepts and creative materials.

You receive only a limited, revocable, nonexclusive right to access the Services for personal, noncommercial shopping and informational purposes.

Without prior written authorization, you may not:

  1. Reproduce, distribute, sell, license, or publicly display protected material.
  2. Create derivative commercial works.
  3. Copy garment designs, patterns, artwork, or original construction details.
  4. Use MAISON MO content to train an artificial intelligence system or dataset.
  5. Remove copyright, trademark, attribution, or ownership notices.
  6. Use MAISON MO imagery or branding to imply affiliation, endorsement, sponsorship, or product authenticity.
  7. Scrape, systematically download, or commercially exploit website content.

Purchasing a product does not transfer any intellectual property rights in the product’s design.

16. Reviews and Submitted Content

Where the Services allow you to submit reviews, comments, photographs, messages, or other content, you retain ownership of your original content.

By voluntarily submitting content for publication or promotional use, you grant MAISON MO a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, format, display, distribute, and use that content for operating, improving, and promoting MAISON MO, subject to applicable law and our Privacy Policy.

You represent that submitted content:

  1. Is truthful.
  2. Reflects genuine experience when presented as a review.
  3. Does not infringe another person’s rights.
  4. Does not disclose confidential or private information without authorization.
  5. Is not unlawful, threatening, defamatory, deceptive, or malicious.
  6. Does not contain malware or harmful code.
  7. Does not impersonate another person.

We may remove content that violates these Terms. We do not prohibit honest reviews, lawful criticism, or genuine opinions.

17. Prohibited Uses

You may not use the Services to:

  1. Violate any law or regulation.
  2. Commit fraud or deception.
  3. Interfere with website security or operation.
  4. Introduce malicious code.
  5. Attempt unauthorized access to accounts, systems, or information.
  6. Circumvent fraud controls, purchase limits, or access restrictions.
  7. Use unauthorized bots, scraping tools, or automated attacks.
  8. Submit false information.
  9. Impersonate another person.
  10. Misuse another person’s payment information.
  11. Harass MAISON MO personnel or other users.
  12. Purchase products for counterfeiting, unauthorized copying, or deceptive resale.
  13. Suggest an unauthorized relationship with MAISON MO.
  14. Use the Services in a way that could expose MAISON MO or others to liability.

We may restrict access, preserve evidence, cancel transactions, report activity, or cooperate with authorities when we reasonably believe unlawful or prohibited conduct has occurred.

18. Third-Party Services

The Services may integrate with or link to payment processors, carriers, analytics providers, social networks, hosting services, and other third parties.

MAISON MO does not control third-party services and is not responsible for their:

  1. Content.
  2. Availability.
  3. Security.
  4. Performance.
  5. Privacy practices.
  6. Separate terms.

Your use of a third-party service may be governed by that third party’s own terms and policies. A link or integration does not necessarily constitute endorsement.

19. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

MAISON MO DISCLAIMS ALL WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  1. THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE.
  2. WEBSITE CONTENT WILL ALWAYS BE COMPLETE OR CURRENT.
  3. DEFECTS WILL ALWAYS BE CORRECTED IMMEDIATELY.
  4. THE SERVICES WILL BE FREE OF HARMFUL COMPONENTS.
  5. PRODUCT COLORS WILL APPEAR IDENTICALLY ON EVERY DEVICE.
  6. A PRODUCT WILL MEET A SUBJECTIVE EXPECTATION NOT EXPRESSLY INCLUDED IN ITS DESCRIPTION.

THIS SECTION DOES NOT EXCLUDE ANY WARRANTY, GUARANTEE, REMEDY, OR CONSUMER RIGHT THAT CANNOT LEGALLY BE DISCLAIMED.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAISON MO AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR:

  1. INDIRECT DAMAGES.
  2. INCIDENTAL DAMAGES.
  3. SPECIAL DAMAGES.
  4. EXEMPLARY OR PUNITIVE DAMAGES.
  5. CONSEQUENTIAL DAMAGES.
  6. LOST PROFITS OR REVENUE.
  7. LOSS OF DATA.
  8. LOSS OF BUSINESS OPPORTUNITY.
  9. REPUTATIONAL LOSS.
  10. LOSSES ARISING FROM THIRD-PARTY SERVICES.
  11. LOSSES THAT WERE NOT REASONABLY FORESEEABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, MAISON MO’S TOTAL AGGREGATE LIABILITY ARISING FROM A PRODUCT, TRANSACTION, OR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO MAISON MO FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.
  2. ONE HUNDRED UNITED STATES DOLLARS.

The exclusions and limitations apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or personal injury caused by negligence where such a limitation is prohibited.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

21. Dispute Resolution, Arbitration, and Class Action Waiver

21.1 Informal Resolution

Before beginning arbitration or court proceedings, you and MAISON MO agree to attempt to resolve the dispute informally.

The party asserting a dispute must send a written Notice of Dispute containing:

  1. The person’s full name and contact details.
  2. The account email, if applicable.
  3. The order number, if applicable.
  4. A description of the dispute.
  5. The relief requested.
  6. Supporting documents reasonably necessary to understand the claim.

The parties will have 60 days after receipt of a complete notice to attempt informal resolution. A statute of limitation will be suspended during this 60-day period to the extent permitted by law.

 

21.2 Binding Individual Arbitration

Except for matters identified below, any dispute, claim, or controversy arising from or relating to the Services, products, communications, transactions, these Terms, or the relationship between you and MAISON MO will be resolved through binding individual arbitration.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, as modified by these Terms.

The arbitrator may award the same individual remedies that a court could award. The arbitrator may not combine claims or award relief for anyone who is not a party to the individual arbitration.

Unless the parties agree otherwise, any hearing may be conducted by telephone, video conference, written submissions, or in a reasonably convenient location.

MAISON MO will pay arbitration fees to the extent required by applicable rules or law.

 

21.3 Exceptions

Either party may:

  1. Bring an eligible individual claim in small claims court.
  2. Seek temporary or preliminary relief from a court to protect intellectual property, confidential information, account security, or prevent unauthorized access while arbitration is pending.
  3. Report conduct to a government authority.
  4. Exercise a right that applicable law does not permit the parties to arbitrate.

 

21.4 Class Action and Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MAISON MO AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY.

NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, REPRESENTATIVE, OR MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ACTION.

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS WITHOUT THE WRITTEN AGREEMENT OF ALL PARTIES.

YOU AND MAISON MO KNOWINGLY WAIVE THE RIGHT TO A TRIAL BY JURY.

 

21.5 Arbitration Opt-Out

You may opt out of the arbitration agreement by sending written notice within 30 calendar days after the date you first accept these Terms.

The notice must include:

  1. Your full name.
  2. Your mailing address.
  3. Your account email, if applicable.
  4. A clear statement that you are opting out of the MAISON MO arbitration agreement.

Opting out of arbitration will not affect the remaining Terms.

 

21.6 Severability

If part of this arbitration agreement is held unenforceable, that part will be severed and the remainder will remain effective, except that if the class action waiver is held unenforceable as to a particular claim, that claim must proceed in court rather than class arbitration.

22. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MAISON MO and its owners, members, managers, officers, employees, contractors, and representatives from third-party claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:

  1. Your unlawful use of the Services.
  2. Your material violation of these Terms.
  3. Content you submit.
  4. Your infringement of another person’s rights.
  5. Fraudulent or unauthorized conduct performed through your account.
  6. Your misuse, commercial copying, counterfeiting, or unauthorized resale of MAISON MO products or intellectual property.

This section does not require a consumer to indemnify MAISON MO for MAISON MO’s own negligence, unlawful conduct, product defect, or other liability that cannot legally be shifted.

23. Events Outside Our Control

MAISON MO will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including:

  1. Natural disasters.
  2. Severe weather.
  3. Fire or flood.
  4. War, terrorism, or civil unrest.
  5. Epidemics or public emergencies.
  6. Labor disputes.
  7. Transportation or carrier disruption.
  8. Supplier or material shortages.
  9. Utility or internet failures.
  10. Cyberattacks despite reasonable security measures.
  11. Government action.
  12. Customs delay.
  13. Changes in law or import restrictions.

This section does not remove any cancellation, refund, or other remedy that applicable law requires.

24. Governing Law and Court Venue

These Terms are governed by the Federal Arbitration Act and, to the extent state law applies, the laws of the State of California, without regard to conflict-of-law principles.

For a dispute that is not subject to arbitration, you and MAISON MO consent to the exclusive jurisdiction of the state and federal courts located in or serving Placer County, California, except where applicable consumer law requires another location.

25. Electronic Communications

By using the Services, you consent to receive agreements, notices, order information, disclosures, and other communications electronically.

Electronic communications satisfy any legal requirement that a communication be in writing, except where applicable law requires another method.

Marketing communications are subject to your choices and applicable law. You may unsubscribe from promotional email using the link included in the message. Transactional and legally required communications may still be sent.

26. Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary to:

  1. Protect the Services or another person.
  2. Investigate suspected fraud or unlawful conduct.
  3. Enforce these Terms.
  4. Respond to legal obligations.
  5. Discontinue a feature or service.

Sections that by their nature should survive termination will remain effective, including intellectual property, payment obligations, disclaimers, liability limitations, indemnification, and dispute resolution.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

MAISON MO may assign these Terms in connection with a merger, financing, restructuring, acquisition, sale of assets, transfer of the business, or operation by an affiliated entity, subject to applicable law.

28. Severability, Waiver, and Entire Agreement

If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective.

A failure to enforce a provision is not a waiver of that provision.

These Terms, the Privacy Policy, the Delivery and Returns Policy, and any product-specific terms displayed at checkout constitute the entire agreement concerning the applicable transaction or use of the Services.

Headings are provided for convenience and do not affect interpretation.
